To ensure the success of your bus hire with Classic Bus Hire, please take time to read our Terms and Conditions of hire. By booking with us you agree to the terms contained within.

Vehicle

A bus or coach provided by Classic Bus Hire, hereby known as a bus or coach.

 

Hirer

A person over 21 hiring a vehicle from Classic Bus Hire for a private function.

 

Passenger

A person travelling on a vehicle provided by Classic Bus Hire when used private hire or scheduled bus service.

 

Private Hire

A vehicle booked for transport of persons to a private function.

 

Scheduled bus service

A stage carriage service provided for use by members of the general public.

 

Driver

A suitably qualified person employed either directly or indirectly by Classic Bus Hire.

 

Conductor

A suitably qualified person employed either directly or indirectly by Classic Bus Hire.

 

 

 

 

APPLICATION 

These Terms and Conditions apply to the hirer whether a contract for vehicle hire has been made verbally, or in writing by the company.

 

QUOTATIONS AND TENDERS FOR BUS HIRE 

Quotations or tenders given out by the company are based on costs prevailing at the time, and are based on details and information given by the hirer. All quotations are valid for 14 days from the date of issue or for a specified period. The company reserves the right to apply any fuel levy surcharges that may apply to the hire or period of hire covered by the initial quotation. Advice on journey times and routing is given in good faith, but does not guarantee that the completion of any vehicle hire journey at a specific time. 

 

These conditions apply whether a contract has been made verbally or in writing. The hirer acts on behalf of all the passengers travelling on the vehicles. If the hirer is a company, group or partnership, an individual must be named as a responsible person.

 

The hirer is responsible for the actions and decisions of all the passengers on board including any additional costs incurred in performing the contract, whether or not they actually travel with the party. The company will only accept instructions from the hirer.

 

 

CONFIRMATION OF YOUR VEHICLE HIRE 

Written or email confirmation by the hirer is the only basis of hiring or for a subsequent alteration in its terms.

 

RESERVATION AND PAYMENT OF YOUR COACH HIRE 

Any requested deposit must be paid in the time stated, and the balance of payment in full must be made when requested, unless the company has agreed in writing to a variation of this condition, or the hirer has an authorised credit account facility with the company, which includes specified payment times and credit limits. The company may by way of its own volition accept delayed payment, this shall be advised to the hirer. We accept payment by bank transfer only.

 

Failure to make payment on time may result in your booking being cancelled. Any payments made will be forfeited as a result of failure to make payments on time.

 

CANCELLATION AND VARIATION BY THE HIRER OF YOUR COACH HIRE 

 

In the event of any action by the hirer to vary the agreed conditions, the company may, provide an additional quotation to cover the variation, agree to the variation at no adjustment of cost or return all (except any deposit) monies paid and without further or other liability cancel the contract.

 

The cost of accommodation, meals and entrance or travel tickets which have already been purchased by the company at the request of the hirer, will be charged to the hirer, plus any administration charges incurred by the company.


Cancellation due to inclement weather conditions will be charged as above.

 

Theatre tickets, or other such ancillary service, once purchased are not returnable and must be paid for in full.

 

If you are a consumer as defined by the Consumer Rights Act 2015 you may have additional rights however the rights to cancel are restricted as you are booking a transport service with a specified date and time.

 

Any cancellation or curtailment of hire should be made in the first instance by verbally contacting the company by telephone, with a further confirmation in writing or email. The following scale of cancellation charges will apply. 

 

TABLE OF CHARGES FOR HIRE CANCELLATION BY THE HIRER

If the hirer wishes to cancel any agreement, the following scale of charges will apply in relation to the total hire charge. The vehicle classification shall be advised at the time of booking.


Vintage Vehicles

 

Days prior to departure date:
91 days or more – deposit only;

90 to day of hire – 100% of hire;

 

Non-Vintage Vehicles

 

Days prior to departure date:

28 days or more – deposit only;

27 days to 8 days – 50% of hire

7 days to day of hire – 100% of hire

 

CANCELLATION OF YOUR VEHICLE HIRE BY THE COMPANY

In the event of any emergency or force majeure, or action by the hirer to vary the agreed conditions, the company may, by returning all monies paid (subject to the terms set out at table of charges for hire cancellation by the hirer) and without further or other liability, cancel the contract. Any refund will generally be made within 28days of cancellation to the nominated bank account of the hirer.

 

PERIOD DURING YOUR BUS HIRE

During the hiring, the company’s driver unless previously specified will maintain the right to decide the route to be taken, with considerations given to weather, road closures, road accidents, and traffic congestion. The driver is subject to EC 561/2006 driving regulations and these must be strictly adhered to at all times, don't worry we will guide you on these complex regulations.

 

The company cannot be held liable for any delays caused by vehicle breakdown, traffic congestion, road closures, weather, or third party services, along with acts of god, war, civil commotion, and force majeure.

 

The hirer is responsible for the punctuality of all passengers, and the company is not liable for anyone arriving or returning late, and thereby missing the bus.  The vehicle will depart at time agreed with the Hirer only.

 

The Customer agrees to indemnify and keep the Company fully indemnified from and against any direct and indirect losses, claims, expenses, damages or liability whatsoever incurred or suffered by the company as a result of the negligence, acts or omissions or default under the contract by the customer, or any Passengers, employees, agents or subcontractors.

 

The Company shall not be liable to the Customer or be deemed to be in breach of the Contract by reason of any delay in performing or any failure to perform any of the Company's obligations under the Contract if the delay or failure was due to any circumstances or cause beyond the Company's reasonable control.

 

Classic Bus Hire reserves the right to levy additional charges for time exceeding that agreed for the booking. 

 

Should the Hirer request an overrun beyond the agreed end time of the booking, the Company may make additional charges as follows: £70.00 for the first hour or part thereof, £140.00 for the second hour or part thereof, £320.00 for the third hour or part thereof and for each and every subsequent hour after three hours or part thereof an additional charge of £70.00 shall be charged. Additional charges shall be payable prior to further use of company vehicles.

 

Overruns will be accommodated at the Company’s discretion and subject to the availability and other commitments of vehicle and crew.

 

VEHICLES

The company reserves the right to substitute other vehicles of similar quality, including those of other operations and may include vehicles not classed as a bus or coach for all or part of the hiring.

 

The hirer may not assume the use of a vehicle between outward and return journeys, or that it will remain at the destination, unless previously agreed in writing with the company.

 

The maximum seating capacity is displayed inside the vehicle and must not be exceeded at any time.

 

Our vehicles are in as used service condition. They have official inspections and conform to the same rigorous standards as new vehicles.

 

HEALTH AND SAFETY

The driver is responsible for the safe carriage of passengers on the vehicle. Any passenger whose conduct is in breach of statutory regulations may be removed or refused entry to the vehicle on the driver’s authority. The hirer will be held responsible for the conduct of passengers and any subsequent damage caused to the vehicle by passengers during the hiring.

 

INSURANCE

All hirers and individual passengers are recommended to obtain personal travel insurance, save for negligence, the company’s liability is limited. It is the responsibility of the hirer to ensure that all items of value are insured separately for loss or damage.

 

COMPLAINTS

In the event of complaint about the company's services, the hirer should endeavour to seek a solution at the time by seeking assistance from the driver or from the company. If this has not provided a remedy, complaints should be submitted in writing and within 14 days of the termination date of the hire. Complaints will be acknowledged within 14 working days and the company will aim to resolve any complaint within 28 days of it being made. SIGNAGE

No bill, poster or notice is to be displayed on any vehicle without the written consent of the company.

 

LEGAL JURISTICTION 

These terms and conditions shall be governed by and in accordance with English law and subject to the exclusive jurisdiction of the English Courts. You further agree total compensation for claims against Classic Bus Hire per group shall not exceed the total booking amount. You agree to forfeit any right to claim compensation if as a result of illegal activities by you or your group on any of our vehicles. 

 

 

GENERAL

Damages - A security deposit may be imposed prior to the hire to mitigate the event of spillage of food and/or drink or other contamination of or damage to the vehicle whether arising from the consumption of drinks aboard or from the behaviour of passengers who have consumed alcohol before travelling or from any other action by passengers. Classic Bus Hire reserves the right at its absolute discretion to request and to hold a security deposit, such deposit to be returned in full to the Hirer following completion of the booking provided that no spillage, contamination or damage has occurred. Classic Bus Hire may retain the deposit in full or in part to mitigate the cost of returning the vehicle to a suitable condition.

 

Charges include, but are not restricted to, the following examples:

 

Per bag of rubbish – £5

 

Cleaning of food or drink spillage – £50

A charge may also be made for any exterior damage to the vehicle caused by inadequate route planning by the Hirer or false information given by venues that the Hirer has booked. Type of vehicle damage shall include (but not restricted to) roof panels, windows, side panels, mirrors, tyres and peripheral equipment.

 

Food and Beverages – Other than on a vehicle fitted specifically for dining purposes, food and beverages except for small items of confectionary may not be consumed on the vehicle without prior agreement with the company.

 

Alcohol – Alcohol may be consumed on the vehicle in moderation at the driver’s discretion. Hirer’s attention is drawn to the sporting events (control of alcohol) regulations act 1985 which forbids the consumption of alcohol whilst travelling to a designated sporting event in England and Wales on a passenger carrying vehicle (PCV). Please note other countries may have their own regulations covering consumption of alcohol, in this case a final decision will be made in accordance with the above noted regulations.

 

Drugs – The carriage and/or use of non-prescribed drugs is strictly forbidden whilst travelling on the company’s vehicles. We reserve all rights to remove those involved with the carriage and or use of non prescribed drugs.

 

The Carriage of Luggage – The driver will endeavour to accommodate all luggage in the vehicle luggage hold, however due to space and weight limitations the company cannot guarantee that all luggage presented by the party will be carried and/or accommodated on any one journey. Under health and safety guidelines the driver can refuse to lift or handle any piece of luggage that appears to or does exceed 20kg in weight. The driver is the sole arbiter as to the carriage and handling of passenger’s luggage.

 

All luggage and personal effects are carried in our vehicles at the owner’s risk. Our vehicle may not have a lockable storage compartment, the company will not be responsible or liable for any theft or damage to properties of passengers travelling on the vehicle, except where there is proof of direct action by one of the company’s employees.

 

Wheelchairs – We are unable to accommodate wheelchairs of any kind inside our vehicle. Due to the age of our vehicles they are not DDA compliant. We may be able carry foldable wheel chairs inside the luggage hold of our vehicles provided they meet the requirements specified in our Vulnerable Passengers policy. 

 

Vulnerable passengers are welcome provided the terms set out in our Vulnerable Passengers policy are met.

 

Lost Property – Items of lost property that have been retrieved and stored may be claimed by calling the company on it office phone number, collection by you will be from Newbury. Lost non perishable items will be disposed of after 28days. Perishable items shall be disposed of on the day.

 

Animals – Animals are generally forbidden to ride on the company’s vehicles, however exemptions apply to registered guide dogs, but the company must be informed prior to the date of hire.

 

Smoking is not permitted on any of our vehicles.

 

Reviews – We welcome objective reviews about the service we have provided. We reserve all our rights in regards inaccurate or vindictive reviews published on any forum including verbal communications. By booking a service with us you agree to not leave vindictive and or inaccurate reviews on any forum including verbal communications. 

 

Promotional Shots – We may from time to time take promotional shots of our buses with passengers in or around the vehicle. You agree to us taking promotional shots and the possible distribution of any shots, you further agree to the copyright remaining with Classic Bus Hire and or it’s Directors.
